Main functions

1. The Management Board of Khanh Hoa Province's Economic Zones and Industrial Parks (hereinafter referred to as the Management Board) is an agency directly under the People's Committee of Khanh Hoa Province, performing the function of direct state management over the Van Phong Economic Zone ( EZ) and industrial parks (IPs) in Khanh Hoa Province as stipulated in Government Decree No. 35/2022/ND-CP dated May 28, 2022 on the management of industrial parks and economic zones (hereinafter referred to as Decree No. 35/2022/ND-CP), managing and organizing the provision of public administrative services and other support services related to investment and production and business activities for enterprises in the EZ and industrial parks in Khanh Hoa Province.

2. The Management Board, established by a decision of the Prime Minister, is under the direction and management of the Provincial People's Committee regarding organization, staffing, work programs, plans, and operating budget; it is subject to the direction, guidance, and inspection of relevant ministries and ministerial-level agencies managing related sectors and fields; it is responsible for closely coordinating with specialized agencies under the Provincial People's Committee in the management of economic zones and industrial parks; it performs the duties of a specialized agency of the Provincial People's Committee when delegated or authorized; and it carries out the tasks and powers of a specialized agency under the Provincial People's Committee as stipulated in Decree No. 35/2022/ND-CP and other relevant laws.

3. The Management Board has legal personality; an account opened at the Provincial State Treasury ; an office; a seal bearing the national emblem; and uses state administrative management funds, operational funds for public services, and development investment capital allocated by the state budget according to the annual plan, as well as other funding sources as prescribed by competent state agencies.

4. The Management Board performs its duties and powers according to the decentralization and authorization of competent state agencies as stipulated in Decree No. 35/2022/ND-CP and other relevant legal provisions.

Main task

1. Perform the duties and exercise the powers as prescribed in Clauses 1 and 2 (except for duties related to foreign labor), and Clause 4 of Article 68 of Decree No. 35/2022/ND-CP.

a) Participate in providing opinions, developing and submitting to ministries, ministerial-level agencies and provincial People's Committees for approval and organizing the implementation of the following tasks:

- Provide input to ministries, ministerial-level agencies, and provincial People's Committees in the development of legal documents, policies, and development plans related to economic zones and industrial parks (when requested);

- Preside over and coordinate with relevant agencies to develop regulations on coordinating work with specialized agencies under the Provincial People's Committee or related agencies to perform assigned tasks and powers under the one-stop and integrated one-stop mechanisms, and submit them to the Provincial People's Committee for approval;

- Preside over and coordinate with relevant agencies and organizations to develop tasks and zoning plans for industrial parks, and tasks and plans for adjusting these plans;

- Develop programs and plans for investment promotion and development of economic zones and industrial parks, and submit them to the Provincial People's Committee for approval;

- Synthesize and assess the labor needs for employment in economic zones and industrial parks, and coordinate with competent state agencies to supply labor to businesses in economic zones and industrial parks;

- The Management Board shall submit the annual budget estimates, operating expenses for public services, and development investment capital, as well as other funding sources (if any), to the competent state agency for approval in accordance with the laws on state budget, public investment, and other relevant laws;

- Coordinate with relevant agencies to organize technology assessment of investment projects, evaluate the technological level and capacity of enterprises; inspect and control technology and technology transfer in investment projects, research and development activities and technology application of enterprises.

b) The specific tasks are as follows:

- Managing, disseminating, guiding, inspecting, and supervising the implementation of regulations, development plans for urban and rural areas, and related plans for economic zones and industrial parks that have been approved by competent state agencies;

- Perform the tasks of the investment registration agency and the Management Board of industrial parks and economic zones in accordance with the law on investment for investment projects in economic zones and industrial parks under the authority of the Management Board;

- Conduct project appraisal and design and construction cost estimation for projects and construction works under delegated or authorized management within economic zones and industrial parks in accordance with the law;

- Granting, re-granting, adjusting, extending, revoking licenses for the establishment of representative offices and terminating the operations of representative offices of foreign organizations and traders located in economic zones and industrial parks in accordance with the law on commerce;

- Fulfill the environmental protection responsibilities of the Management Board as stipulated by environmental protection laws;

- Receiving registration of price frameworks and infrastructure usage fees from investors implementing investment projects for the construction and operation of industrial park and functional zone infrastructure within economic zones;

- Inspect, monitor, and evaluate the implementation of investment objectives as stipulated in the Decision approving the investment policy;

- Coordinate with police units and other competent agencies and units in inspecting the work of maintaining security and order, and preventing fires and explosions;

- Resolving difficulties and obstacles faced by investors in economic zones and industrial parks;

- Receive statistical reports and financial reports from businesses in economic zones and industrial parks;

- Coordinate with the Ministry of Finance in building and managing the national information system on economic zones and industrial parks;

- Submitting quarterly and annual reports to the Ministry of Finance and the Provincial People's Committee on operational status;

- Providing support and information to enable businesses in economic zones and industrial parks to connect and cooperate with each other;

- To perform certain tasks and exercise the powers of the specialized labor agency under the Provincial People's Committee;

- Organize emulation movements and reward programs for businesses in economic zones and industrial parks;

- Inspecting and resolving complaints and denunciations, preventing and combating corruption, waste, and negative practices;

- Perform tasks as prescribed by law and regulations of the Provincial People's Committee;

- To act as the focal point for advising the Provincial People's Committee on the development, management, and support of the transformation process;

- Perform other duties and exercise other powers as prescribed.

2. Tasks as stipulated in Article 69 of Decree No. 35/2022/ND-CP

a) Organize the preparation and submission of reports to the Provincial People's Committee for approval by the competent authority.

- Project to expand and adjust the boundaries of the Economic Zone;

- Formulate and adjust the tasks and overall planning of the Economic Zone;

- Proposal for issuing local government bonds;

b) Develop and submit to ministries, ministerial-level agencies, and provincial People's Committees for approval.

- Coordinate with relevant agencies and organizations to develop and adjust land use plans and schemes within the economic zone;

- Formulate tasks and zoning plans, and detailed plans for functional zones within the Economic Zone;

- Annual and five-year plans for the development of the Economic Zone;

- List of investment projects and development investment capital plans;

- Establish price frameworks and applicable fees and charges within the Economic Zone;

c) The Management Board directs or organizes the implementation of tasks.

- Issuing, reissuing, amending, supplementing, and extending licenses for the establishment of representative offices;

- Hire domestic and foreign consultants to provide investment promotion consulting services;

- Investment decisions for Group B and C projects using public investment capital;

- Propose a list of projects and organize the selection of investors;

- Managing and utilizing investment capital for the development of economic zones under its jurisdiction;

- Preside over and coordinate with relevant agencies in carrying out the maintenance and upkeep of the infrastructure system;

- Coordinate with relevant units and organizations to carry out compensation and land clearance tasks;

- Coordinate with local authorities and relevant agencies to ensure smooth operation within the economic zone.

3. Other tasks:

a) To perform the tasks stipulated in Clause 4, Article 41 of the Law on Urban and Rural Planning;

b) Perform the tasks stipulated in Articles 36 and 40 of Decree No. 35/2022/ND-CP.

4. Perform tasks that have been delegated, authorized, and assigned by the Provincial People's Committee.

Perform the tasks delegated and authorized under Clause 3, Article 68 of Decree No. 35/2022/ND-CP and relevant legal regulations, except for receiving explanatory reports from enterprises in the Economic Zones and Industrial Parks regarding the need to employ foreign workers for positions that Vietnamese workers cannot fill; and simultaneously perform the tasks assigned by the Provincial People's Committee.

5. The Management Board is the focal agency for managing investment activities in economic zones and industrial parks in Khanh Hoa province.

Ministries, ministerial-level agencies, and local state management agencies, when implementing specialized tasks in economic zones and industrial parks, are responsible for coordinating and seeking opinions from the Management Board to ensure unified state management.
